Acceptance of Terms

By visiting capitalgoose.io, joining our waitlist, submitting any form, or otherwise using any part of the Service, you agree to these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you may not use the Service.

If you are using the Service on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

Description of Service

Capital Goose is an AI-powered business funding marketplace. We help small business owners and entrepreneurs by:

  • Collecting basic business information through our platform.
  • Using proprietary algorithms to match your profile with potentially suitable funding offers from our network of third-party lenders and financial providers.
  • Presenting those matched offers to you for your review and consideration.

The Service is currently in pre-launch. Joining the waitlist grants you priority notification and early access when the platform goes live. Features described on the website are subject to change prior to launch.

Eligibility

To use the Service, you must:

  • Be at least 18 years of age.
  • Be a legal resident of or duly incorporated in the United States.
  • Be operating or intending to operate a lawful business.
  • Provide accurate and truthful information.

We reserve the right to deny access to the Service to anyone at our sole discretion.

Waitlist & Communications

By joining our waitlist, you consent to receive emails from Capital Goose including launch updates, product announcements, and relevant funding information. You may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us at info@capitalgoose.io.

Joining the waitlist does not guarantee access to the platform, funding offers, or any specific product or feature. Waitlist position and priority access are provided in good faith but are not contractual commitments.

Capital Goose Is Not a Lender

Important: Capital Goose is a funding marketplace and technology platform — not a bank, lender, broker-dealer, or financial advisor. We do not make credit decisions, extend credit, or provide financial advice.

Any funding offers you receive are made exclusively by third-party lenders who are solely responsible for their own credit decisions, terms, rates, and underwriting. Capital Goose is not a party to any loan or funding agreement between you and a lender.

Before accepting any funding offer, you should carefully review the lender’s terms and conditions, interest rates, repayment schedule, and all associated fees. Consider consulting with an independent financial or legal advisor.

User Obligations

You agree to:

  • Provide accurate, current, and complete information at all times.
  • Notify us promptly of any changes to your information.
  • Use the Service only for lawful purposes and in accordance with these Terms.
  • Not attempt to circumvent, disable, or interfere with any security-related features of the Service.
  • Not use the Service to submit fraudulent applications or misrepresent your business.
  • Not scrape, reverse-engineer, or systematically extract data from the Service without our written consent.

We reserve the right to suspend or terminate your access if we believe you have violated these obligations.

Intellectual Property

All content on the Service — including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, and software — is the property of Capital Goose or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may view, download, and print content from the Service for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content without our prior written permission.

The Capital Goose name, logo, and all related marks are trademarks of Capital Goose, LLC. You may not use them without our written consent.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CAPITAL GOOSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the total fees paid by you to Capital Goose in the 12 months preceding the claim, or (b) $100 USD.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Capital Goose and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including any intellectual property or privacy rights; or (d) any claim that information you submitted to the Service caused damage to a third party.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If unresolved after 30 days, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association’s Commercial Arbitration Rules. The arbitration shall take place in Delaware. Each party shall bear its own costs.

Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. If you are on our waitlist, we will notify you by email of significant changes.

Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
